Penalties for DUI Convictions in Florida
In Florida, if you are caught driving with a blood alcohol level of .08 or higher, you can be charged with a DUI. Depending on the circumstances surrounding your case, the state has mandatory penalties for DUI convictions.
If this is your first offense, you can expect the following penalties:
- Fine ranging from $500 to $1000
- Jail time of up to 180 days
- Up to 12 months of probation
- A driver's license suspension of 6 months to a year
- Mandatory DUI & substance abuse course
- Mandatory 10 day vehicle immobilization
- Community service of up to 50 hours
All of these penalties can increase if you are found to have an enhanced blood alcohol level, or if you have a minor in the vehicle at the time of the arrest.
Many Florida circuits offer DUI Diversion Programs for certain DUI crimes. The Legal Justice Center can determine if a DUI Diversion Program is applicable to your case. These programs typically last 12 months, but upon successful completion, your charge will be reduced to Reckless Driving. In the event that a DUI Diversion Program is unavailable to you, our criminal defense attorney in Fort Lauderdale is prepared to take your case to trial and ensure that you are aggressively defended and all of your Constitutional rights are protected.
